These Terms of Service ("Terms") govern your access to and use of the qbmerch.com website (the "Site") and any purchases you make through it. By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
QB Merch is the apparel division of Quantum Biologics, Inc., a privately-held biotechnology company incorporated in the United States. Questions about these Terms can be sent to support@qbmerch.com.
You must be at least 18 years of age, or the age of majority in your jurisdiction, to place an order through the Site. By placing an order you represent that you meet this requirement and that the payment information you provide is accurate and belongs to you.
We sell branded apparel. All products are subject to availability and may be discontinued at any time. Prices are shown in U.S. dollars and do not include applicable sales tax or shipping, which are calculated at checkout. We reserve the right to correct any pricing errors on the Site and to refuse or cancel any order placed at an incorrect price.
Your submission of an order is an offer to purchase the products listed in that order. We reserve the right to accept, limit, or refuse any order at our sole discretion. Our acceptance of your order is confirmed by our shipping confirmation email, which forms a binding contract between you and QB Merch.
Payments are processed by Stripe, Inc., a PCI-compliant third-party payment processor. We do not store your full payment card information on our servers. By submitting payment information, you authorize us (through Stripe) to charge the amount shown at checkout to the payment method you select.
We ship within the United States and to select international destinations. Delivery estimates are provided at checkout and are not guaranteed. Title and risk of loss for products pass to you upon delivery to the carrier. QB Merch is not responsible for delays caused by the carrier, customs, or force majeure events. Our returns policy is published separately on the Returns & Refunds page and is incorporated into these Terms by reference. In summary: unworn, unwashed shirts may be returned within 30 days of delivery for a refund to the original payment method, less return shipping.
All content on the Site — including the QB word mark, DNA vial logo, product graphics, photography, and copy — is owned by or licensed to Quantum Biologics, Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from any Site content without our prior written consent, except as permitted for personal, non-commercial use.
You agree not to use the Site to: (a) violate any law or regulation; (b) infringe the rights of any third party; (c) transmit viruses, malware, or other harmful code; (d) scrape, data-mine, or otherwise extract Site content without authorization; or (e) interfere with the Site's operation or security.
The Site and all products are provided "as is" and "as available" without warranties of any kind, express or implied, except to the extent required by applicable law. We do not warrant that the Site will be uninterrupted, error-free, or free from viruses or other harmful components.
To the fullest extent permitted by law, Quantum Biologics, Inc., its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site or any products purchased through it. Our aggregate liability to you for any claim arising out of or related to these Terms or the Site will not exceed the amount you paid to us in the 12 months preceding the claim.
You agree to defend, indemnify, and hold harmless Quantum Biologics, Inc. from any claim, demand, loss, or damage — including reasonable attorneys' fees — arising from your breach of these Terms, your violation of any law, or your infringement of any third-party right.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the seat of arbitration in Delaware. You waive any right to participate in a class action.
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of the Site after an update constitutes your acceptance of the revised Terms. Material changes will be announced on this page for at least 30 days.
